TERMS AND CONDITIONS OF SIMPLE.CO.NZ LTD

EFFECTIVE: 1 FEBRUARY 2010

The following terms are issued by SIMPLE.CO.NZ Ltd to ensure there are no misunderstandings at any time during the working relationship between customers and SIMPLE.CO.NZ Ltd.

SIMPLE.CO.NZ Ltd requests that for all customers, for whom they provide general support, give advice, prepare financial statements and prepare tax returns for, agree to the following:

  • SIMPLE.CO.NZ Ltd will prepare Financial Statements, Income Tax Returns, and advise the customer regarding their income tax, accounting and business matters (the “Services’) from information provided by the customer.
  • SIMPLE.CO.NZ Ltd will not audit or otherwise verify the data provided by the customer.
  • The customer agrees that all information provided is accurate.
  • SIMPLE.CO.NZ Ltd may provide the customer with questionnaires or worksheets to assist SIMPLE.CO.NZ Ltd in obtaining the necessary information.
  • The customer is responsible for providing SIMPLE.CO.NZ Ltd with all the information required for the preparation of complete and accurate tax returns.
  • While SIMPLE.CO.NZ Ltd can and will prepare requested tax returns or any Inland Revenue returns on the customer’s behalf, this does not absolve the customer of responsibility of meeting their IRD obligations.
  • The customer should retain all the documents and other data that form the basis of income and deductions for a period of seven years, as these may be necessary to prove the accuracy and completeness of the returns to the Inland Revenue Department.
  • For the entities the customer has provided IRD numbers for, the customer agrees to linking their tax records to SIMPLE.CO.NZ Ltd’s agency list. The authority extends to all tax types to enable SIMPLE.CO.NZ Ltd to become the mailing address for correspondence from the Inland Revenue Department (where requested by the customer).
  • The customer allows SIMPLE.CO.NZ Ltd to communicate on their behalf with the Inland Revenue Department by way of phone, fax, email, or internet regarding the customer’s tax affairs.
  • SIMPLE.CO.NZ Ltd will use their judgment in resolving questions where the Tax Law is unclear, or where there may be conflicts between the Inland Revenue Department's interpretations of the Law and other supportable positions.  We will use our professional judgement within the boundaries of NZ law.  If there is an instance where an issue is raised/highlighted requiring more specialist input, we will discuss the situation and options directly with the customer prior to proceeding.
  • The customer’s returns may be selected for review by the Inland Revenue Department.  Inland Revenue normally contacts the agent first in providing notice of a review or audit of the returns.  SIMPLE.CO.NZ Ltd does have the expertise to manage such a review but will notify the customer immediately to discuss the way forward with the review.  The customer is not bound to employ SIMPLE.CO.NZ Ltd but it is recommended.
  • SIMPLE.CO.NZ Ltd will issue invoices for payment according to services rendered.  The fees for all services will be based upon our fixed pricing structure and invoiced on completion of the draft submission/draft documentation.
  • The customer accepts that all invoices are due within 7 days of issue and that documentation will not be finalised or returns submitted until payment has been made.
  • SIMPLE.CO.NZ Ltd will endeavour in all instances to supply full and correct financial documents for Services requested.  If any detail/expense is accidentally omitted, we will correct the error and supply revised documents at no charge.  However, if the error is a result of incorrect information supplied by the customer, an additional charge may be incurred and this will be stated upfront.
  • These terms will continue from year to year. SIMPLE.CO.NZ Ltd will endeavour to communicate directly with the customer any amendments to these Terms and Conditions. SIMPLE.CO.NZ Ltd will publish a current copy of the Terms and Conditions on the SIMPLE.CO.NZ Ltd website www.simple.co.nz.

Privacy Policy

At SIMPLE.CO.NZ Ltd we respect your privacy.  We will not rent, sell, give, lend or otherwise forward your personal information to any other company, association or organisation.

Refund Policy

SIMPLE.CO.NZ LTD does not offer a refund for any of its services once they have been engaged and work has commenced. Refunds of the deposit amount for each respective service will only be provided in the following instance:
  • The customer notifies us in writing, either by email, post or fax, and cancels their request of work, prior to Simple.co.nz Ltd commencing activity on the service(s) engaged.

Credit Card Security – Secure Payments

Deposit payments can be completed online using either a MasterCard or Visa credit card.
SIMPLE.CO.NZ LTD does not store, retain or process any credit card information when undertaking credit card payments.  For all credit card payments the customer is immediately redirected online to a secure hosted payment page of ANZ Bank.  All credit card payments will be sent to and processed by ANZ eGate™.

On completion of payment you will receive both an on screen confirmation and a following e-mail confirmation that the transaction has been approved.
